In the event of any conflict between the German and English versions of these Terms of Use, the German version shall prevail.
These Terms of Use govern your individual use of the Nuqo platform. By checking the box at sign-up, you accept them on your own behalf as a user. They do not constitute, replace, or amend the commercial agreement between Nuqo and your organisation, and you do not bind your organisation to any commercial terms by accepting them.
The commercial relationship between Nuqo and your organisation — fees, term, service levels, data processing, and liability between the companies — is governed by the agreement between Nuqo and your organisation (for example, an Order Form incorporating the Terms of Service / AGB of Nuqo) and the Data Processing Agreement (DPA). Those documents prevail over these Terms of Use on any matter they cover. These Terms of Use govern only your personal use as an individual user.
You confirm that you act on behalf of a business and are authorised to use the platform on behalf of your organisation. Keep your access credentials confidential; you are responsible for activity under your account. Notify Nuqo without undue delay of any suspected unauthorised access.

The platform produces quote calculations and suggestions using AI. Results may be incomplete or inaccurate and are decision-support, not a substitute for your own review. Review and approve results through qualified judgement before any external use (for example, issuing a quote). Nuqo is not liable for outputs used unchecked or incorrectly checked.
Keep the non-public information of Nuqo (the platform, its features, evaluation results, pricing) confidential and use it only for your authorised use. This is without prejudice to, and defers to, any non-disclosure agreement between Nuqo and your organisation, which governs confidentiality at the company level.
Where your access is provided for evaluation or proof-of-concept, the platform is provided on an as-is basis, without warranty or service-level commitment, and may be changed or discontinued. Do not rely on it for production decisions during evaluation.
Nuqo processes your personal account data in accordance with the Privacy Policy. Processing of personal data contained in documents your organisation uploads is governed by the Data Processing Agreement (DPA) between Nuqo and your organisation.
Nuqo may update these Terms of Use with reasonable notice. Material changes will be notified (by email or in-app); continued use after notice constitutes acceptance. Immaterial changes (for example, clarifications) do not require renewed acceptance.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin, to the extent permitted by law.
